For many immigrants, deciding to hire an attorney or immigration service is one of the most important decisions they will ever make. You trust that the person handling your case is protecting your future, your family, and your opportunity to remain in the United States.
Unfortunately, many individuals who sought help through Alexandria Lozano and Luz Legal, and several other law firms, are now learning that their cases may contain serious problems. If you are one of them, you are not alone—and there are options.
At Hope Immigration, we know this situation is overwhelming. Our goal is not to judge anyone for seeking help. Our goal is to help you understand where your case stands, explain your options honestly, and work with you to find the best path forward.
What Is Happening?
Reports have raised concerns about how certain VAWA (Violence Against Women Act), U Visa, and T Visa applications were prepared and filed through Luz Legal and some other law firms. Among these, Luz Legal appears to be the most significant source of concern, with more than 50,000 humanitarian immigration cases reportedly pending before USCIS.
Every case is different. Some applications may have been prepared correctly. Others may contain mistakes, missing information, or even statements that the client never intended to submit.
If you believe your case may be affected, do not assume that withdrawing your application is the safest course of action. Depending on your immigration history and the type of application you filed, withdrawing a pending case could have serious consequences, including the possibility that USCIS could issue a Notice to Appear (NTA) initiating removal proceedings. Before taking any action, your case should be carefully reviewed by an experienced immigration attorney.
Because of this, it is important not to assume that your case is either completely fine or completely fraudulent. Every case must be carefully reviewed based on its own facts.
What Should You Do If You Were a Luz Legal Client?
The first step is not to panic. Instead, gather as much information as you can.Â
This may include:
- Copies of any applications that were filed
- USCIS receipt notices
- Approval or denial notices
- Emails or messages exchanged with Luz Legal
- Any drafts of declarations or personal statements you may have written
- Any documents you signed
These records can help your new attorney determine what you knew, what information you provided, and what was ultimately submitted to USCIS.
Why Reviewing the Entire File Is So Important
One of the biggest challenges in these cases is that the documents filed with USCIS may not match what the client actually provided.
For example:
- Your personal declaration may have been changed before it was filed.
- Information may have been added or removed without your knowledge.
- Supporting evidence may be incomplete or inconsistent.
The only way to know is by obtaining and reviewing the complete immigration file and comparing it to the documents you originally prepared.
Can My Case Be Saved?
Maybe—but every case is different.
Sometimes a case can be corrected. Sometimes it can be rebuilt. Sometimes a different immigration option may be available.
In some situations, the best strategy may be to continue with the existing application after correcting or supplementing the record. In others, withdrawing the application and pursuing a different form of relief may be appropriate. That decision should never be made without first understanding the potential immigration consequences, including the possibility of being placed into removal proceedings.
Unfortunately, there are also situations where an attorney must honestly tell a client that there is no legal way to move forward with the current application.
While that is never easy to hear, receiving honest legal advice is far better than continuing with a case that cannot legally succeed.
Honesty Matters
Immigration applications are signed under penalty of perjury.
Attorneys cannot continue pursuing claims they know to be false, and ethical attorneys have a responsibility to fully evaluate the facts before moving forward.
That is why a thorough review is so important. An experienced attorney will verify the evidence, ask questions, and determine what can be supported before recommending the next steps.
Important Things to Know
If you are changing attorneys, there are several practical issues to keep in mind:
- Filing a new attorney appearance (Form G-28) does not automatically change where USCIS sends your mail. Your mailing address must also be updated separately.
- If you decide to represent yourself, make sure USCIS has your current address so you continue receiving important notices.
- Missing deadlines or appointments can seriously affect your case.
- Some applications may require rebuilding from the beginning, while others may only need corrections.
These are details that can have a significant impact on your immigration case.
Every Case Deserves an Individual Review
With tens of thousands of people potentially affected, it can be tempting to assume every application was handled the same way.
That simply is not true.
Some earlier filings may be well-supported. Others may contain significant problems. The only responsible approach is to carefully review each case before making conclusions.
